HOTEL CONTRACT

RIGHTS AND OBLIGATIONS SAN ANTONIO RURAL ACCOMMODATION

  • Pursuant to Articles 79 and 81 of Law 300 of 1996, the Hotel Registration Card is proof of the execution of the accommodation contract between ALOJAMIENTO RURAL SAN ANTONIO and the GUEST. The contract is accepted by the GUEST'S signature in the registration book. This contract is an adhesion contract; therefore, the GUEST adheres to the stipulations contained herein.
  • 1. PURPOSE. By virtue of this contract, ALOJAMIENTO RURAL SAN ANTONIO will provide accommodation services to the GUEST in the room and its accessories, in exchange for a price, for the number of days indicated on the Hotel Registration Card. In no case may the term exceed 30 consecutive days. 1.1.- The room and the price or rate per night will be those indicated on the Hotel Registration Card. Notwithstanding the foregoing, ALOJAMIENTO RURAL SAN ANTONIO will be authorized to change rooms and the guest must accept it, provided that it is to a room of equal or better conditions or it is due to a situation of force majeure. 1.2.- Check-in time is from 3:00 p.m. (15:00) on the day of arrival and check-out time is until 12:00 p.m. (12:00 p.m.) on the day of departure. The period between these two hours corresponds to the hotel day. Early check-in or late check-out will be subject to availability and the guest must pay the corresponding fee. 1.3.- Accommodation will be provided regardless of the guest's actual stay in the room. Partial use will result in payment of the full rate. 1.4.- The provision of the services covered by the contract and any additional services offered by the hotel will be subject to availability and the schedules, shifts, or physical availability of the necessary supplies, goods, facilities, or spaces.
  • 2. PRICE. 2.1.- The price of this contract corresponds to the nightly fee that the GUEST agrees to pay, which corresponds to the amount indicated on the registration card, including taxes. All of this will be described in the corresponding collection account. If taxes do not apply, since it is an exempt or excluded transaction, the collection account will be charged the rate without taxes. 2.2.- The GUEST must also pay all charges for food, beverages, laundry, and in general, any other charges incurred during their stay and that they decide to charge to their account. 2.3.- The GUEST declares that they have been informed of the rates, fees, and general room prices per night, including taxes. Rates may vary from one night to the next. 2.4.- Failure to make the agreed payment will result in late payment interest being charged to the GUEST at the maximum rate permitted, as certified by the Financial Superintendence.​
  • 3. CUSTODY OF MONEY AND VALUABLES: ALOJAMIENTO RURAL SAN ANTONIO will not accept money or valuables for safekeeping. Valuables such as jewelry, cameras, money, computers, cell phones, equipment, or utensils left in the room or service areas will be at the sole risk of the GUEST, since ALOJAMIENTO RURAL SAN ANTONIO assumes no responsibility in the event of loss or damage.
  • 4.- OBLIGATIONS:
  • 4.1.- OF THE ALOJAMIENTO RURAL SAN ANTONIO. 4.1.1.- Provide the service covered by the contract. 4.1.2.- Attend to, receive, process, and respond to suggestions, complaints, or claims submitted by the guest. 4.1.3.- Any other obligations established by law.
  • 4.2.- OF THE GUEST. 4.2.1.- Identify themselves with a valid ID to check into the HOTEL. Presenting their national identity card (if Colombian) or their passport (if foreign). Minors must present a valid ID. 4.2.2.- Pay the value of the accommodation plus applicable taxes. 4.2.3.- Pay all bills and charges made to their account. 4.2.4.- Maintain decent conduct and dress appropriately. 4.2.5.- Be liable for their obligations and those of their companions or guests, even in the case of minor negligence. 4.2.6.- Register at the hotel reception all companions or guests of the GUEST who go to their room and pay the corresponding fee or value for each of them. 4.2.7.- Respect the number of people per room. 4.2.8.- THE GUEST acknowledges that the practice of sports, physical exercise, driving ships or vehicles, use of instruments or tools and, in general, any activity that involves risk or that may be considered dangerous, will be their decision, under their exclusive responsibility and implies that the GUEST has the skills and knowledge that allow them to assume said risks, exonerating ALOJAMIENTO RURAL SAN ANTONIO and its owners and employees of any responsibility in the event that they suffer any damage or injury. 4.2.9.- Use the furniture, fixtures, equipment and, in general, the facilities of both the room and the ALOJAMIENTO RURAL SAN ANTONIO, in an appropriate manner, preserving them in the condition in which they are found and therefore will be responsible for any damage or loss of the elements and property of the ALOJAMIENTO RURAL SAN ANTONIO, even for slight negligence. In the event of total or partial loss or damage to the property of the ALOJAMIENTO RURAL SAN ANTONIO due to a cause attributable to the GUEST or to their belongings, they will recognize the price set by THE ALOJAMIENTO RURAL SAN ANTONIO, plus an additional 50% as a penalty. 4.2.10.- Respect the authority of the HOTEL Manager. 4.2.11.- Allow the right of inspection and/or surveillance of the room by officials of theALOJAMIENTO RURAL SAN ANTONIO. This right will be exercised reasonably and includes the right to enter or search the room when, in the judgment of the Manager of ALOJAMIENTO RURAL SAN ANTONIO, it is necessary. 4.2.12.- Allow employees and staff of ALOJAMIENTO RURAL SAN ANTONIO access for routine tasks and room cleaning.
  • 5. CONTRACT TERMINATION. The accommodation contract will terminate in the following events: 5.1- Upon expiration of the agreed term. 5.2- Upon breach of any of the obligations of the parties and specifically upon failure to pay the price or fee charged by the GUEST or upon failure to pay for food and beverages or other complementary services that the GUEST has charged to the room or to his/her personal account. 5.3- In the event that, in the sole judgment of ALOJAMIENTO RURAL SAN ANTONIO, the behavior or attire of the GUEST is inappropriate, or in the judgment of ALOJAMIENTO RURAL SAN ANTONIO, it threatens the peace and/or health of other guests or visitors to ALOJAMIENTO RURAL SAN ANTONIO. Paragraph: Termination of the contract does not exonerate or release the GUEST from the payment of any outstanding balances.
  • 6. EFFECTS OF TERMINATION. 6.1.- Upon termination of the contract, ALOJAMIENTO RURAL SAN ANTONIO may freely use the room. 6.2.- Upon termination of the contract and regardless of the cause for termination, ALOJAMIENTO RURAL SAN ANTONIO is authorized to enter the room, prepare and sign an inventory of the guest's belongings and luggage in the presence of two (2) witnesses, and remove them from the room to leave them in a safe and adequate deposit, without liability of ALOJAMIENTO RURAL SAN ANTONIO and at the expense and risk of the GUEST. 6.3.- ALOJAMIENTO RURAL SAN ANTONIO has the right of retention over the GUEST's luggage and property found in the room and, therefore, if there is any balance due to the GUEST, ALOJAMIENTO RURAL SAN ANTONIO will not deliver the luggage and property until the entire outstanding balance is paid. 6.4.- If the GUEST does not pay the outstanding account with ALOJAMIENTO RURAL SAN ANTONIO, after thirty (30) days from the date of non-payment, ALOJAMIENTO RURAL SAN ANTONIO may dispose of and sell the GUEST's luggage and belongings to cover the outstanding obligations with their proceeds, including late payment interest incurred, plus all costs and expenses for the deposit and in general in which ALOJAMIENTO RURAL SAN ANTONIO may have incurred due to non-compliance. Any surplus, if any, will be made available to the GUEST and in case of a deficit, ALOJAMIENTO RURAL SAN ANTONIO may initiate the corresponding actions to obtain full payment of the amount owed.
  • 7. MISCELLANEOUS.
    7.1.- ALOJAMIENTO RURAL SAN ANTONIO does not permit sex tourism nor does it permit the sexual exploitation or abuse of girls, boys, or adolescents. Guests may not enter their rooms for sex tourism purposes. Anyone who does so will be subject to imprisonment of 5 to 10 years and a fine of 50 to 100 current monthly minimum wages. The penalties indicated in the previous section will be increased by up to half (1/2) when the conduct is carried out with minors under twelve (12) years of age.
    7.2.- Legal nature of the contract. In accordance with Article 79 of Law 300 of 1996, the lodging contract is a rental contract, commercial in nature, and of adhesion.
    7.3.- Charges for smoking in the rooms. All rooms at ALOJAMIENTO RURAL SAN ANTONIO are smoke-free. If the GUEST smokes in the room, for each day they do so, they must pay (i) the cost incurred by ALOJAMIENTO RURAL SAN ANTONIO to deodorize and clean the room, estimated at an amount equivalent to USD 100, settled at the representative market rate on the day of payment, and (ii) the value of two (2) nights at the rate corresponding to their accommodation, since the cleaning and deodorization process means that ALOJAMIENTO RURAL SAN ANTONIO cannot use the room for the following two (2) nights.
    7.4.- The accommodation contract is evidenced by the hotel registration card issued by ALOJAMIENTO RURAL SAN ANTONIO, accepted by the GUEST's signature, which attests to their adherence to the stipulations contemplated herein. THE GUEST expressly accepts that the net sum of money recorded in the collection account will provide enforceable grounds. The GUEST authorizes ALOJAMIENTO RURAL SAN ANTONIO to fill in the blanks on the hotel registration card.    ​
  • PRIVACY NOTICE. AUTHORIZATION FOR THE USE OF DATA AND INFORMATION. By signing this contract, the GUEST expressly authorizes ALOJAMIENTO RURAL SAN ANTONIO, with NIT 35334841-9, as a tourist accommodation operator, to collect and use the information and personal data provided by the GUEST on the Hotel Registration Card, such as name, address, identification, nationality, date of birth, email address, personal preferences and interests, work or activity, in accordance with the secure information processing policies established by the Accommodation itself and by current laws, for the purpose of conducting loyalty activities and contacting the owner of the information to send service surveys after each stay to evaluate the service provided, and to communicate invitations, offers, promotions, service portfolios, or general information aimed at encouraging the GUEST to continue using the Accommodation or other hotels belonging to ALOJAMIENTO RURAL SAN ANTONIO, and to offer the corresponding services. The GUEST, as the data subject of the personal data, shall enjoy all legal rights, including those expressly described in Article 8 of Law 1581 of 2012. In particular, the GUEST shall have the right at all times to know, access, update, and rectify their personal data, revoke the authorization granted, or request the deletion of information when appropriate.
